Withdrawal information before purchase
EU requirement
Legal basis: Under EU Consumer Rights Directive (2011/83/EU), Art. 6, the merchant must inform the consumer about the right of withdrawal before the contract is concluded.
The withdrawal information must be provided in a clear and comprehensible way and be available to the consumer in good time before the contract is concluded.
Checklist for merchants
- Withdrawal information is visible on the website (e.g. under “Terms”, “Withdrawal rights”, or “Contact”)
- The information is before the “Buy” / “Order” click (e.g. link in checkout)
- Content: 14-day period, when the period starts (e.g. for physical goods: day after receipt), note on exclusions (hygiene, personalized, etc.)
- Model withdrawal form (Art. 14) – The app provides an electronic form; the information should refer to it
Technical implementation
The EU Withdrawal Form app provides:
- An electronic withdrawal form (theme block)
- Automatic calculation of the withdrawal period
- Consideration of exclusions (products, B2B)
The withdrawal information itself (text, placement, legal completeness) is the merchant’s responsibility and must be included in the shop/theme.
Note
The app does not replace legal advice. The final wording and classification of the withdrawal information should be done with a legal advisor.
